Federal Court Judge Benitez Finds California Magazine Ban Violates Second Amendment Duncan v. Becerr

In one of the strongest judicial statements in favor of the Second Amendment to date, Judge Roger T. Benitez of the U.S. District Court for the Southern District of California determined on Friday that California’s ban on commonly possessed firearm magazines violates the Second Amendment.


The case is Duncan v. Becerra.


The NRA-supported case had already been up to the U.S. Court of Appeals for the Ninth Circuit on the question of whether the law’s enforcement should be suspended during proceedings on its constitutionality. Last July, a three judge panel of the Ninth Circuit upheld Judge Benitez’s suspension of enforcement and sent the case back to him for further proceedings on the merits of the law itself. 


Judge Benitez rendered his opinion late Friday afternoon and handed Second Amendment supporters a sweeping victory by completely invalidating California’s 10-round limit on magazine capacity. “Individual liberty and freedom are not outmoded concepts,” he declared.  


In a scholarly and comprehensive opinion, Judge Benitez subjected the ban both to the constitutional analysis he argued was required by the U.S. Supreme Court in District of Columbia v. Heller and a more complicated and flexible test the Ninth Circuit has applied in prior Second Amendment cases. 


Either way, Judge Benitez ruled, the law would fail. Indeed, he characterized the California law as “turning the Constitution upside down.” He also systematically dismantled each of the state’s purported justifications for the law, demonstrating the factual and legal inconsistencies of their claims.

NRA-ILA California ban on high-capacity magazines law-abiding Americans self-defense lawful purpose

NRA-ILA Executive Director Chris W. Cox hailed the decision as a “huge win for gun owners” and a “landmark recognition of what courts have too often treated as a disfavored right.” 


“Judge Benitez took the Second Amendment seriously and came to the conclusion required by the Constitution,” Cox said. “The same should be true of any court analyzing a ban on a class of arms law-abiding Americans commonly possess for self-defense or other lawful purposes.”


Unfortunately, Friday’s opinion is not likely to be the last word on the case. The state will likely appeal to the Ninth Circuit, which has proven notably hostile to the Second Amendment in past decisions.


Nevertheless, the thoroughness of Judge Benitez’s analysis should give Second Amendment supporters the best possible chance for success in appellate proceedings, particularly if the case ultimately lands before the U.S. Supreme Court.


In the meantime, Friday’s order prohibits California from enforcing its magazine restrictions, leaving its law-abiding residents safer and freer, at least for the time being.

California's High Capacity Magazine Law... CRUSHED!

California High Capacity Magazine Law illegal US court rules magazines may hold more than 10 round

In 2016, California banned so-called “Large Capacity Magazines” which hold more than 10 rounds of ammunition under their Proposition 63. The California Rifle & Pistol Association filed a lawsuit (Duncan v. Becerra) in mid-2017 before the law went into effect.


A U.S. District court just made a favorable decision in the case (for those of us that celebrate the entire Bill of Rights). In his opinion, Judge Roger T. Benitez wrote:

 

“California’s law prohibiting acquisition and possession of magazines able to hold any more than 10 rounds places a severe restriction on the core right of self-defense of the home such that it amounts to a destruction of the right and is unconstitutional under any level of scrutiny,” . . .


“California’s ban is far-reaching, absolute, and permanent. The ban on acquisition and possession on magazines able to hold more than 10 rounds, together with the substantial criminal penalties threatening a law-abiding, responsible, citizen who desires such magazines to protect hearth and home, imposes a burden on the constitutional right that this Court judges as severe.” . . .


“The magazine ban arbitrarily selects 10 rounds as the magazine capacity over which possession is unlawful. … The ban on magazines that hold more than 10 rounds amounts to a prohibition on an entire class of ‘arms’ that is overwhelmingly chosen by American citizens for the lawful purpose of self-defense,”


 Although this is a great win for the firearms community, it is not likely to be over. According to The Hill, “[the plaintiffs] acknowledged that the state was likely to appeal Friday’s decision to the 9th Circuit.”


So, Californians, you might want to get some magazines.

These fine men & women, (brothers & sisters) in law enforcement are just an example of the high caliber professionals I had the honor of working with for nearly 30 years.


Apart from my regular patrol responsibilities, in 1992, I was appointed as one of the Brea Police Department Firearms Instructor & Range Master staff. In this capacity I was able to assist other Range Masters with Brea PD's monthly duty weapon qualifications as well as, "other" types of weapon qualifications. In addition, the Range Master staff was tasked with providing instruction in different new and innovative types of police weapons and tactical training: officer survival, various police shotguns, AR-15, H&K G36 "assault rifles," combat tactics, active shooter, hostage negotiations, low-light tactics, simunition(s) and edged weapon defense.

   

We trained the department's officers in other new innovative police weapons known as: non-lethal weapons or less-lethal weapons or less-than-lethal weapons. These non-deadly weapons gain compliance through pain-inducing technology intended to be less likely to kill a living target. Examples: (police baton, ASP, PR-24, Taser, beanbag shotgun, pepper spray, tear gas and flashbang grenades, etc). We trained and deployed all of these conventional and non-conventional weapons and almost anything firearms or self-defense related. 


In time the Brea Police Department grew to provide police services to the expanding needs of the City of Brea as well as the City of Yorba Linda. The training demands of deploying nearly 145 sworn police officers was an huge task, especially since department policy demanded that each and every officer was required to qualify with their duty weapon on a monthly basis.

Going back to recall almost five decades of law enforcement experience... Back in the day, Brea Police Department was pure "REVOLVER COUNTRY." Just Smith & Wesson and Colt revolvers only, but in a wide variety of calibers like: 38, 38 Special, 38 Special + P, 357, 357 Magnum, 45 ACP & 44 Magnum. 


As time passed, our duty weapons began changing from revolvers to semi-autos. What didn't change were the wide variety of calibers and of course Smith & Wesson and Colt remained. 


Many of my mentors eventually retired and eventually I became one of the department's Firearms Instructors & Range Masters.

Buena Park Unveils Memorial for Fallen Police Officers

 BUENA PARK, Calif. (KABC) -- Buena Park honored their fallen police officers as the city unveiled the Buena Park Fallen Officers Memorial Highway along Beach Boulevard on Tuesday.

The memorial was dedicated to the three officers who died while protecting the Buena Park community.

•  Darrel Cate's end of watch came in September of 1972, when a suspect shot and killed him.  


•  Motor Officer Tyler Pinchot was hit by a car while pursuing a traffic violator in 2003 and died after being in a coma for 100 days.  


•  SWAT Officer Daniel Ackerman collapsed suddenly after a fitness test in July of 2011. The 31-year-old died the next morning.

Brea Police Department: In Memory of Detective Danny Valenzuela

May 1, 1956 - May 23, 1995 

Danny Valenzuela was a friend and fellow law enforcement brother of mine. He came to the Brea Police Department on August 24, 1980, from the La Verne Police Department. Danny worked patrol for about seven years. He served as a motor officer for about three years. Danny was an excellent motorcycle rider and assisted in training several motorcycle officers. In 1990, Danny transferred into the detective bureau and became a burglary detective. He worked burglary for about three years and then moved to robbery / homicide. 


Danny was part of the crime suppression unit, hostage negotiations team, and a member of the Brea Police Department Bicycle Patrol Unit. During his career with the Brea Police Department, Danny received numerous awards for his courage and leadership, including receiving the department's Distinguished Service Award in 1988.


On May 23, 1995, while participating in  Police Department Bicycle Patrol  training, Danny suffered a fatal heart attack. Danny became the first Brea Police Officer to die in the line of duty. He is greatly missed at the Brea Police Department. He is survived by his wife and four children.

Brea Police Department: In Memory of Detective Terry Fincher

November 4, 1947 - May 22, 1996 

 

Terry Fincher was a friend and fellow law enforcement brother of mine.  He began his career with the Brea Police Department on July 5, 1979, as a reserve officer. He began as a full-time officer on February 8, 1980. Terry worked many assignments, including motors. He served as an investigator, handling several different case loads, including robbery / homicide, burglary, and narcotics. Terry was a peer counselor, a member of the Tactical Arrest and Containment team (TAC), and a member of the Hostage Negotiations Team.


Terry was held in high regard by his fellow officers, receiving the Associate Officer of the Year in 1980 and Officer of the Year in 1981. Terry was awarded the Brea Police Department's Medal of Honor in 1987, for his actions during an encounter with a gunman.


On May 22, 1996, while investigating a crime, Terry was struck by a train and killed. Terry is survived by his wife, four children, and two grandchildren.

Countering the Mass Shooter Threat

Mass shootings have become all too familiar today and that is unacceptable. This course is designed to give us the information and data to identify, reduce, control, and then eliminate these incidents.

At the end, you'll be able to use this data and develop a comprehensive plan designed to eliminate the scourge of these shooters once and for all.

Remember 9/11: ‘His Name Is Christopher Amoroso’

His name is Christopher Amoroso and at this point on that awful day the smoke and flames are so intense that people are coming down from those buildings in waves. They're coming down from both towers.  They're coming down from all four sides.  Strangers were holding hands on their way down, comforting one another. It take s along time to die from 90 floors up.  Every second is filled with despair.  The sky behind is filled with falling bodies. The air above them is filled with smoke and flames  and the awful sound of those bodies hitting the sidewalk are echoing in his ears.   


He’s going back.  He’s going to drop off the pregnant lady.  He’s going to go back into that building a fourth time.  The building will fall and Christopher Amoroso will not  come home to his wife and baby tonight.  


He will never come home again.  Do you understand that nobody told him to go?  


Why does one man go up those steps again and again and again and again while thousands are coming down?


Because he’s a sheepdog.

Off-Limits Locations Even With A Permit:

  • Events or gun shows – you shall not carry both a firearm and its compatible ammunition at the same time
  • Firearms are prohibited in the state Capitol, any Governor or constitutional officer’s office, or any legislative office
  • Polling place
  • Public and private schools, as well as, college campuses


When Carrying A Concealed Weapon You Shall Not

  • Consume any alcoholic beverages
  • Carry in any locations whose primary purpose is the distribution of alcoholic beverages for on-site consumption
  • Be under the influences of drugs, prescribed or not
  • Refuse to surrender or reveal any weapons when requested by a peace officer
  • You shall not interfere with any peace officer trying to perform his/her duties
  • Carry a weapon that is not listed on your permit
  • Carry a firearm in circumstances or times not listed on permit


When A Permit Is Not RequiredAnyone over the age of 18, who has not previously been prohibited from possessing a firearm, may keep and carry a loaded firearm in his/her                       home, place of temporary residence, campsite, or private property owned by that person.

Traveling
With a permit you may carry at:

  • State parks
  • State or National Forests
  • Road Side Rest Areas
  • In any vehicle


Handguns
California will not prevent a US citizen, over the age of 18 from transporting a firearm capable of being concealed so long as it is not loaded and it is stored in an approved and locked container.

Rifles & Shotguns
It is not required for a non-concealable firearm to be in a locked container. However, it must be unloaded with a trigger lock, while being transported.

Registered Assault Weapons
Assault weapons that have been registered may be transported between certain locations. They must also be unloaded in a locked container during transportation.

Open Carry
Open carry is not legal in California.

Large Capacity Magazines
An injunction was issued for the portion of the law that prohibited possessing a large capacity magazine in your home, on June 30, 2017. However, the manufacturing, importation, and sale of large capacity magazines are still prohibited.
Large capacity magazines are defined as a detectable ammo feeding mechanism that has the capacity to accept more than 10 or more rounds.

What Is Considered A ‘Loaded Firearm’?

  • In California, a firearm is considered loaded when the firearm and its compatible ammunition are in the immediate possession of the same person.
  • Additionally, a firearm is considered loaded when a round is attached in any degree to the firearm, including in the chamber, magazine, or an attached, etc.

CALIFORNIA GUN LAW GUIDE 

Upcoming Regulations Regarding Firearms Ghost Gun Starting on July 1, 2018, all individuals interesting in constructing or manufacturing a firearm must apply for a special serial number with the DOJ first. Anyone with a current firearm that does not possess a specific serial number must apply for one before January 1, 2019. Assault Weapon with the Bullet Button Feature Beginning January 1, 2017, any firearm featuring the “bullet button” will be classified as an assault weapon and must be registered before the deadline on June 30, 2018. 


Redefined meaning of Assault Weapon Incoming regulations will redefine an “assault weapon” as a semi-automatic pistol or semiautomatic centerfire rifle with no fixed magazines with these specific characteristics. 


A pistol with any of the following:

  • Pistol Grip
  • Thumbhole stock
  • Grenade Launcher
  • Forward Pistol Grip
  • Flash Suppressor
  • Second-hand grip
  • Threaded barrel
  • Can use a magazine outside the grip
  • Shroud attached to the barrel

Exempt from punishment a person who was in possession of an assault weapon prior to January 1, 2017, if requirements are met: Anyone in possession of their assault weapon that does not have a fixed magazine, including weapons with an ammunition feeding device that can be removed with a tool between January 1, 2001, to December 31, 2017. All those that have registered with the DOJ before the deadline on June 30, 2018.

  • A state-issued business license will be required for anyone interesting in selling 500 or more rounds of ammunition. All sales will be restricted to an exact business location or gun shows.
  • Necessary documentation and a background check are required for The Department of Justice to give an ammunition vendor license. Any employees selling any ammunition or firearm will be required to submit to a background check and complete all mandatory paperwork & training.
  • Starting January 1, 2018, all ammunition related sales must be done so through a certified vendor. Ammo bought from a different state or online must be delivered to a licensed vendor and handed to the purchaser after passing a background check.


Ammunition Sales Records

  • Beginning on July 1, 2019, all ammunition sales are required to be kept and recorded by a licensed vendor and later reported to The Department of Justice.
  • All records’ confidentiality will be maintained unless needed for the purposes of law enforcement.


Ammunition Sales for the Shooting Range

  • No background checks will be needed for individuals seeking to purchase ammunition at a range with the sole requirement that the ammunition is not taken from the facility.

Sales Conducted at Gun Shows

  • All ammo on show at any California gun show must be contained in a sealed container unless being observed by a prospective buyer with the assistance of a licensed vendor/employee.
  • Aside from security or law enforcement, no one should have a firearm and matching ammunition in their possession at the same time.


Dangerous Ammunition

  • Any manufacturing, sale, transportation, importation or intention to sell any ammunition designed specifically to penetrate armor or metal is banned in California.


Applications for Ammunition Vendor License

  • All applicants interested in receiving a license must submit their applications to The Department of Justice, along with necessary documents:
    • Certificate of Eligibility obtained after passing a background check.
    • Valid State Board of Equalization Sellers permit
    • Business or regulatory license required by local government
    • Federal Firearm License (if licensed federally)


    Sales between Private Parties

  • All business between two private parties must be done so through a licensed ammunition dealer and adhere to the following fees:
    • DOJ fee.
    • Vendor is allowed to apply an additional fee for processing and recording of sale.
    • The fee cannot be more than 5 dollars if the purchaser is present.
    • If the buyer is not present, the vendor may charge an additional fee for any storage needs that is priced at an agreed amount before any ammunition is received.


    Displaying Ammunition

  • All ammunition must be displayed in a sealed and locked container.
  • Ammo must not be accessible to the purchaser without the vendor or employee providing the required assistance.
