If you have a CCW License for the State of California; or a concealed carry permit for any other state, you’ve probably gone through some kind of qualification process such as a background check, application, legal aspects and firearms training. While the process can vary widely by state, the issuance of permits and licenses fall into three main categories: MAY-ISSUE, SHALL-ISSUE & CONSTITUTIONAL CARRY. Firearms attorney Tom Grieve breaks them down for you in this segment of “Ask an Attorney.”
May-issue states have discretion in handing out concealed weapons permits. If you live in one of these states and meet all of the requirements — background check, training, etc. — you may be given a permit … or you may not. Despite this contingency, many may-issues states make getting a concealed carry permit pretty straightforward.
In a shall-issue state, if you meet all of the requirements, you shall be given a license. While this is typically easier than in a may-issue state, it still involves an application process investigation and wait time.
In a constitutional carry state, there is no permit (or at least one isn’t mandatory). There may still be a permit available for reciprocity’s sake though.
What Does May Issue Mean?
May Issue means that applicants must pass basic requirements and the issuing authority (county sheriff, police department, etc.) is allowed to use their own discretion in either issuing or denying a permit. Some may-issue states require an applicant to show “good cause” for obtaining a permit, while others require the applicant to show he or she is of suitable character and may require character references in order to authorize a permit. Other states require a mental health records check. There are currently nine may-issue states.
What Does Shall Issue Mean?
Shall Issue means that as long as an applicant passes the basic requirements set out by state law, the issuing authority (county sheriff, police department, state police, etc.) is compelled to issue a permit. In other words, local law enforcement officials cannot deny an applicant a permit if the applicant meets all of the criteria. There are currently 41 shall-issue states, including permitless-carry states that issue permits for purposes of reciprocity (allowing residents of their state to carry in other states with favorable reciprocity). Also, there are states that may be identified as shall-issue that, in practice, operate on a may-issue basis.
Tim Schmidt, founder of the USCCA, made an appearance on Fox Business News on May 25, 2017. More Americans are receiving their concealed carry permits, with already 15.7 million in the U.S. as of this May. The year 2017 has been the highest amount in one year to date.

Concealed carry reciprocity, although complicated in practice, is a relatively simple term. Reciprocity simply means your concealed carry permit or license is valid beyond just your issuing state; the rights between states are reciprocated. You must follow the laws of the state in which you are carrying, however, which may be different from your issuing state.
For example, if you have a Non-Resident Utah Concealed Carry Permit you may legally carry in 38 States: Alabama, Alaska, Arizona, Arkansas, Colorado, Delaware, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Michigan, Mississippi, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Mexico, North Carolina, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, Washington, West Virginia, Wisconsin, and Wyoming.

If you are an Orange County resident, follow these simple steps:
1. Visit the Orange County Sheriff CCW page at www.ocsd.org/ccw (click on CCW application on the left of the screen).
2. Apply online by clicking on "NEW CARRY CONCEALED WEAPON LICENSE.
3. You will eventually need to complete a Live Scan (electronic fingerprint background) and take a course approved by the Orange County Sheriff's Department. You can do this before your interview but we encourage you to wait until you get conditional approval to move forward with the process. Taking the course and live scan will speed up the process and in many cases the CCW will be issued at the time of interview.
